Naidu Falls Victim To Law Made By Him!

The YSR Congress party government in Andhra Pradesh headed by Y S Jagan Mohan Reddy served a final notice on prominent realtor and industrialist Lingamaneni Ramesh to demolish his palace on the banks of Krishna river at Vundavalli in Amaravati in which Telugu Desam Party president and former chief minister N Chandrababu Naidu has been staying for nearly five years.

Interestingly, the notice was served by AP Capital Region Development Authority, which was created by Naidu himself in 2014 by enacting a legislation in the state assembly in the name of APCRDA Act.

The said act was supported by even by Jagan and his party legislators who were in opposition then.

Particularly, the sections 115 (1) and 115 (2) of the Act, under which the APCRDA issued notices were incorporated by Naidu with a view to preventing mushrooming of unauthorised constructions.

Now, the provisions of the Act have been used now by the Jagan Mohan Reddy government to slap notices on Naidu’s rented house.

As per the nine-page notice served on Naidu’s residence by the APCRDA, the construction of ground floor and first floor along with swimming pool and ground floor dressing room etc. of the building are illegal, as the said construction was done without any prior permission from the competent authority.

Moreover, the building is located within 100 metres from Krishna river course in an extent of 1.318 acres. The owner sought time for furnishing documents in support of his argument. But, he had not furnished any even after 10 days.

Apparently, the authorities of APCRDA had done a lot of exercise and taken legal advice before invoking the Act to drive away Naidu from his rented residence.

The officials were very cautious and selective in their language, to ensure that the receiver of the notice will have no chance to approach the court or challenge the orders. 

The notice also not did not question the ownership of the property, but questioned the legality of the permanent structures which are in violation of the river conservation laws of the land. 

The rules, judgments and other matters relating to the river conservation by the National Green Tribunal, too were followed thoroughly in drafting the notices and the communication.

Going by the notices, it is not going to be easy for the owner of the house to escape demolition. Thus, Naidu has no option but to vacate the house at the earliest.
