New USCIS Update: F1 OPT can now work for Consulting

It’s good news for F-1 students on STEM OPT working at the client site.

USCIS announced that STEM OPT employee can work for Consulting/Staffing agencies.

Agencies may seek to employ students under the STEM OPT program, but only if they will be the entity that provides the practical training experience to the student and they have and maintain a bona fide employer-employee relationship with the student.

STEM OPT participants may engage in a training experience that takes place at a site other than the employer’s principal place of business. Readmore!

With regard to the updated reporting requirements, both the student and the employer are required to report any material changes to the university’s designated school official (DSO) by providing an updated form I-983 training plan. Further, the employer is required to report a STEM OPT worker’s termination or departure to the DSO within 5 business days.

While this is great news for OPT students, however given the recent changes in the unlawful presence rule, Students on OPT/H1B should avoid unemployment days. As you know that students on initial OPT can't be unemployed beyond 90 days.
