KCR plan to drag Tamilisai to court backfires

Bharat Rashtra Samithi president and Telangana chief minister K Chandrasekhar Rao’s plan to drag state Governor Tamilisai Soundararajan to the court of law by questioning her discretion not to clear the bills passed by the state assembly has backfired.

The Telangana government moved the Supreme Court against the Governor stating that the latter was creating a "Constitutional impasse" by refusing to act on several Bills passed by the state legislature.

However, chief justice of India D Y Chandrachud said the Supreme Court cannot issue notice to the Governor asking her explanation as to why she has not cleared the bills passed by the state legislature.

“We cannot issue notices to the Governor and seek her answer. We can only issue notice to the Union government,” the CJI said, posting the matter for hearing on March 27.

Solicitor General of India Tushar Mehta said Tamilsai was Constitutional functionary. “Perhaps she might have received the bills and she will respond to it when she felt them appropriate,” he said.

When Justice Narasimha, who was part of the CJ bench agreed with him and said notices cannot be issued to the Governor, Tushar Mehta sad the court cannot give notices even to the Centre. 

Senior advocat Dushyant Dave, arguing for the state government asked the bench to take note of the Solicitor General, who represents the Centre.
